The federal WARN Act is the nationwide baseline: it generally requires 60 days' written notice for a covered plant closing or mass layoff at employers with 100+ employees, with remedies of back pay and benefits enforced through the courts. Search the IN database directly
Indiana runs a searchable WARN database, so this is the quickest of the routes — you can check a specific employer in a minute.
- 1Open the official database and search your employer's legal name, not its brand name — filings use the entity that employs you, which is often different.
- 2Try a partial name too. Subsidiaries and staffing entities file under names most employees never see on a payslip.
- 3Note the notice date and the effective date separately. The gap between them is what tells you whether the required notice period was honoured.
- 4Screenshot or save the record. Databases are refreshed in place, and an entry can change without a version history.
Penalties & employee remedies
Because Indiana has no statute of its own, the remedies are federal: back pay and benefits for the violation period, plus a possible civil penalty payable to local government.
Back pay
Back pay and benefits for each day of violation, capped at the lesser of 60 days or one-half the days the employee worked.
Civil penalty
Up to $500 per day to the local government, avoidable if the employer pays affected employees within three weeks of ordering the layoff.
How to raise it
There is no Indiana agency complaint route for a federal WARN shortfall — it is pursued in court. Separately, Indiana Department of Workforce Development (Rapid Response) provides Rapid Response and reemployment services regardless of whether WARN applied.
Major exceptions & special cases
- Federal WARN's three exceptions apply — faltering company, unforeseeable business circumstances, and natural disaster. Indiana adds none.
Remote workers
Federal WARN follows the single site of employment, which for a remote worker is often the site they report to rather than their home. Fact-specific.
