The federal WARN Act is the nationwide baseline: it generally requires 60 days' written notice for a covered plant closing or mass layoff at employers with 100+ employees, with remedies of back pay and benefits enforced through the courts. Penalties & employee remedies
Because Georgia has no statute of its own, the remedies are federal: back pay and benefits for the violation period, plus a possible civil penalty payable to local government.
Back pay
Back pay and benefits for each day of violation, capped at the lesser of 60 days or one-half the days the employee worked.
Civil penalty
Up to $500 per day to the local government, avoidable if the employer pays affected employees within three weeks of ordering the layoff.
How to raise it
There is no Georgia agency complaint route for a federal WARN shortfall — it is pursued in court. Separately, Georgia Department of Labor / WorkSource Georgia (Rapid Response) provides Rapid Response and reemployment services regardless of whether WARN applied.
